Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Vivance Travels website, mobile experience, and related booking services (collectively, the “Services”). By accessing or using our Services, you agree to these Terms.
If you do not agree, please do not use the Services. We may update these Terms from time to time. Continued use after changes means you accept the revised Terms.
About Vivance Travels
Vivance Travels is a travel agency platform that helps customers search for and book flights, hotels, holiday packages, and related travel products. In many cases we act as an intermediary between you and third-party suppliers such as airlines, hotels, tour operators, and payment providers.
Supplier rules, schedules, fares, and availability are controlled by those third parties and may change without notice.
Eligibility and Accounts
You must be legally capable of entering into a binding contract to use the Services. When you create an account, you agree to provide accurate information and keep your login credentials confidential.
You are responsible for activity under your account. Notify us promptly if you suspect unauthorised use.
- One account should be used only by the registered individual or authorised representative.
- We may suspend or close accounts that appear fraudulent, abusive, or in breach of these Terms.
Bookings and Confirmations
A booking request is not confirmed until payment (where required) is successfully completed and we or the supplier issue a confirmation, ticket, voucher, or booking reference.
Please review passenger names, dates, itinerary, fare rules, and contact details carefully before payment. Incorrect names or details may lead to denied boarding, change fees, or non-refundable tickets.
- E-tickets, hotel vouchers, and package confirmations are the primary proof of booking.
- Keep your booking reference and payment/order ID for support requests.
- Round-trip or multi-segment trips may be issued as one or more tickets under a single application reference.
Pricing, Taxes, and Fees
Displayed prices typically include base fare and applicable taxes/fees as shown at checkout. Additional charges may apply for baggage, seats, meals, resort fees, local taxes, visa services, or other optional products.
Currency conversion (where offered) is for display convenience and may differ slightly from the final charged amount due to bank or card network rates.
Payments
Payments are processed through secure third-party payment gateways. By paying, you authorise the charge for the selected products and any disclosed service or convenience fees.
If a payment is successful but confirmation is delayed, do not pay again. Check My Bookings and contact support with your order or payment reference.
Cancellations, Changes, and Refunds
Cancellations, date changes, and refunds are governed by the fare or rate rules of the airline, hotel, or package supplier, and by applicable law. Service fees charged by Vivance Travels may be non-refundable even when a supplier refund is available.
You can often review cancellation charges from My Bookings before submitting a cancel request. Refund timelines depend on the supplier and your bank or card issuer after we initiate the refund.
Travel Documents and Passenger Responsibility
You are solely responsible for ensuring that all travellers hold valid passports, visas, health documents, and any other entry or transit requirements for the itinerary.
We do not guarantee that any particular visa or document advice is complete for your trip. Check official government sources before travel.
Airline, Hotel, and Supplier Rules
Each supplier’s conditions of carriage, hotel policies, and package terms apply in addition to these Terms. Those rules control check-in times, baggage allowances, no-show policies, child ages, and similar matters.
Schedule changes, delays, cancellations, and overbooking are handled under supplier policies. We will help communicate options where reasonably possible, but we are not the carrier or hotel operator.
Acceptable Use
You agree not to misuse the Services. Prohibited activities include:
- Attempting to scrape, reverse engineer, or disrupt the website or booking systems.
- Using automated tools to place abusive or speculative bookings.
- Providing false traveller, payment, or identity information.
- Infringing intellectual property or privacy rights of others.
Limitation of Liability
To the fullest extent permitted by law, Vivance Travels is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Services or from supplier performance failures.
Our total liability for any claim relating to a booking is limited to the service fees you paid to Vivance Travels for that booking, except where liability cannot be limited under applicable law (including for proven fraud or wilful misconduct).
Intellectual Property
The Vivance Travels name, logos, website design, and content are protected by intellectual property laws. You may not copy, modify, or distribute our materials without prior written permission, except for personal, non-commercial use of booking confirmations issued to you.
Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms or the Services, subject to any mandatory consumer protections that apply to you.
